Q: I got indicted for second degree forgery which is a felony and theft by unlawful taking under $300 which is a misdemeanor. I have a public defender which the court appointed to me. She really doesn't care about my case because she gets paid either way. She called yesterday and said the prosecuting attorney offered a plea for my case. I have to decide by Sept. 29 whether to take it. She said she could try bargaining with him up until that date, but if I didn't take a plea then I will have to go to jury trial. I am not going to jury trial because I confessed to the crime and helped the detective working on my case, which my lawyer said was my worst mistake. I have never had a record so I didn't know any better at the time. Anyway the plea offer is two years. This sounds a little harsh since it is a first time offense and a non violent crime. I know people who have committed a heck of a lot worse crimes than I did and never spent a day in jail. They got supervised probation or house arrest. But they also had a good lawyer. So should I take the plea? Or should I try to come up with the money for a good lawyer which probably won't happen since I only have 13 days left before I have to decide. Any suggestions? A: YES, try for a better lawyer! Sell any assets to do so! No one should go to jail for an offense involving $300! If for some reason you can't find better atty in time, stand up in court on your hind legs and plead for an extension to allow you to secure counsel of your choice now that you've secured financial arrangements only recently made available to you. Assure judge you are actively seeking an attorney and expect to come to terms shortly. Then liquidate whatever it takes and sign a retainer with a qualified mouthpiece! Start with the guy who got your pals off!
