Q: My father in law is a tourist here, he is about 59 years old, never broke the law in his home town in the philippines. He is here on a tourist visa and on his way home from his friends house accross town in our City, he was asked to buy liquour by a "minor" she was obviously a cop, and he so naively went on with saying yes... buys it, cops, lights, handcuffs, the story is pretty cut and dry, he was supposed to return to Manila on the 18th of October, but he has been given a court date of October 23. Is there a possibility for him to serve jail time? and will this be a problem when we want to pettition him for residency and citizenship? Thanks in advance! P.S. We know what he did was bad, we have repremanded him till his ear fell off. So please be nice and offer constructive advice. Please:) This happened in California.
A: Ordinarily, no. Procuring liquor for a minor is nearly always punished by fine rather than by imprisonment. The exception would be if there is a serious accident or death from the procurement. http://janus.state.me.us/legis/statutes/28-A/title28-Asec2081.html Cheers, Bruce
